Overview

This website, ivospirov.com, is operated by Ivo Spirov ("we", "us", "our"), an artist based in Los Angeles, California. By visiting the site or buying from us, you agree to these Terms of Service. If you do not agree, please do not use the site.

We may update these terms from time to time. The version posted here is the one that applies. Continuing to use the site after a change means you accept it.

The work

Originals, including the ochii minis, are painted by hand. Each original is one of one: colors, brushwork and canvas edges vary, and these variations are part of the work, not defects. Photographs and room scenes on the site are shown to give a sense of scale and color, and screens display color differently, so the piece you receive may look slightly different.

Prints are limited editions and are signed and numbered where stated. Apparel is made to order or in small runs; sizes and fit are described on each product page.

Orders and payment

All prices are in US dollars. Taxes and any shipping charges are shown at checkout before you pay. Payments are processed securely through Shopify; we do not see or store your full card details.

An order is accepted when we confirm it by email. Because originals are one of one, if two orders for the same piece arrive at once, the first completed checkout gets it and we will refund the other in full. We may refuse or cancel an order if a product is listed with an error in price or description, if we suspect fraud, or if we cannot ship to the address given. If we cancel a paid order, we refund the full amount to the original payment method.

Shipping

Shipping options, costs and delivery estimates are shown at checkout. Risk of loss passes to you when the order is handed to the carrier. If a piece arrives damaged, email us within 7 days of delivery with photos of the work and the packaging so we can make it right.

Returns and refunds

Questions about returns, exchanges or refunds can be sent to info@ivospirov.com before or after you order. Where our Refund Policy is published, it forms part of these terms.

Artwork and copyright

All artwork, characters (including the ochii), images, text and designs on this site are owned by Ivo Spirov and protected by copyright and other intellectual property laws. Buying an original or a print gives you ownership of that physical object only. It does not transfer copyright or any right to reproduce, adapt, print, sell or use the artwork or characters commercially, including on merchandise, in NFTs, or to train or prompt AI models. You may share photos of work you own for personal, non-commercial use with credit to Ivo Spirov.

Using the site

You agree not to misuse the site, including by attempting to access it in unauthorized ways, scraping or copying its content in bulk, interfering with its security, or using it for anything unlawful.

Third-party services

The site runs on Shopify and may link to or use other services, such as payment providers, shipping carriers and social media. Those services are governed by their own terms, and we are not responsible for them.

Personal information

How we collect and use personal information is described in our Privacy Policy.

Disclaimer and limitation of liability

The site and its content are provided "as is". To the fullest extent allowed by law, we are not liable for indirect, incidental or consequential damages arising from your use of the site or your purchases, and our total liability for any claim is limited to the amount you paid for the order in question. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Los Angeles County, California.
